1. Introduction
Welcome to StampChat, a service operated by Lunarvia (Pty) Ltd. By using the Service, you agree to these Terms.
2. Eligibility
- Be at least 18 years old.
- Act on behalf of a legitimate business.
- Have authority to bind that business.
3. Description of Service
StampChat is a digital loyalty platform providing businesses with a customer wallet, QR-based stamp issuing, rewards, vouchers and customer engagement tools. WhatsApp and email are supported as secure sign-in and notification channels.
The Service depends on third-party platforms such as WhatsApp and our payment gateway. Their availability or policy changes may affect functionality.
4. Free Trial
StampChat may offer a 30-day free trial for evaluation purposes.
Multi-location and franchise businesses:
- The free trial applies to one (1) business location only.
- Any additional branches, locations, or franchises are billable immediately, including during the trial period.
- Trial access may not be duplicated, extended, or reused across multiple locations.
Continued use of the Service after the trial period constitutes agreement to commence a paid subscription.
5. Account Registration
- Provide accurate information
- Keep credentials secure
- You are responsible for all activity
6. Acceptable Use
- No spam, fraud, or illegal use
- Comply with the policies of any third-party platform used to access the Service, including WhatsApp
- No unauthorised access attempts
- No reverse engineering
- Only use customer personal information collected through StampChat for the loyalty purposes it was collected for
7. Subscription & Payments
Subscriptions are billed monthly in advance unless agreed otherwise. Fees are payable in ZAR.
Non-payment may result in suspension or termination of access.
Pricing may change with 30 days’ notice.
8. Intellectual Property
All technology and branding are owned by Lunarvia (Pty) Ltd.
You retain ownership of your data, but grant us the right to process it to provide the Service.
9. Privacy and Data Protection Roles
We process data in accordance with POPIA. See our Privacy Policy for details.
In relation to personal information about your customers that you collect through the Service, you are the responsible party under POPIA and StampChat acts as an operator, processing that information only on your instructions and for the purpose of providing the Service.
10. Service Availability
The Service is provided “as available”. We are not responsible for third-party outages or downtime, or for interruptions caused by events outside our reasonable control, including power outages or load-shedding, internet service disruptions, or other acts beyond our control.
11. Termination
We may suspend or terminate access for breach, misuse, or non-payment.
12. Limitation of Liability
We are not liable for indirect or consequential damages. Total liability is limited to fees paid in the last three months.
13. Indemnity
You indemnify us against claims arising from misuse or breach of these Terms.
14. Changes to Terms
Continued use after updates means you accept the revised Terms.
15. Governing Law
These Terms are governed by South African law.
16. Refund & Cancellation Policy
Subscriptions may be cancelled at any time and remain active until the end of the billing period.
Payments are non-refundable unless required by law or approved at our discretion in exceptional cases.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lunarvia (Pty) Ltd regarding the Service and supersede any prior agreements on the same subject.
19. Assignment
We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without our written consent.
